Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with our Designated Copyright Agent. Your counter-notification must include:

  • Your physical or electronic signature
  • Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled
  • A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification
  • Your name, address, telephone number, and email address
  • A statement that you consent to the jurisdiction of the federal court in your jurisdiction, or if you are outside the applicable jurisdiction, that you consent to jurisdiction in the location where we operate
  • A statement that you will accept service of process from the person who provided notification of the alleged infringement or an agent of such person

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our website and services or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Misrepresentations

Under the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. We reserve the right to seek damages from any party that submits a notification or counter-notification in violation of the law.

Processing Time

Upon receipt of a valid DMCA notification, we will:

  • Remove or disable access to the allegedly infringing material
  • Notify the content provider or user that we have removed or disabled access to the material
  • Take reasonable steps to promptly notify the alleged infringer of the complaint

If we receive a valid counter-notification, we may restore the removed content unless the copyright owner files a court action seeking an order to restrain the alleged infringer from engaging in infringing activity.

Limitation of Liability

We act as a neutral intermediary in these disputes and do not make any independent determination regarding the validity of copyright claims. By submitting a DMCA notification or counter-notification, you acknowledge that we are not responsible for determining whether content infringes your copyright or whether removed content was mistakenly identified.

Non-Copyright Complaints

This DMCA Policy applies only to claims of copyright infringement. If you believe content on our platform violates other rights (such as trademark, privacy, or defamation), please contact us separately at support@jelvian.online with details of your concern.

International Users
